Terms of Service

Effective 2 November 2026

These Terms govern your use of the Wildheart app, the wildheart.app website, and everything we serve through them (together, the "Service"). The Service is operated by Concept Adventure LLC, a Texas limited liability company, which is also the seller of record on the App Store. By using Wildheart you agree to these Terms. If you do not agree, do not use it.

The one that matters most. Wildheart is a planning aid, not a guide and not a safety device. Trail data comes from public sources and can be wrong, out of date, or missing. Conditions change. You are responsible for your own judgment, navigation, and safety on the trail. The full version of this is below and it is worth reading.

Trail data and your safety

Trail information in Wildheart is assembled from public and third-party sources, including OpenStreetMap and public land-management data. We check what we can and we say so when we are unsure, but we cannot warrant that any of it is accurate, current, or complete. A trail may be closed, rerouted, washed out, on private land, or gone. A water crossing that was ankle-deep last week may not be today. Elevation and distance are computed from terrain models and can be off.

Routes you build or draw in Wildheart, including routes the app generates or reshapes for you, may cross terrain that is unsafe, impassable, closed, or not legally open to you. The app does not know what the ground looks like today.

You alone are responsible for deciding whether a hike is within your ability, for checking current conditions and closures with the land manager, for carrying appropriate navigation and safety equipment, and for turning around. Do not rely on Wildheart, or on any phone, as your only means of navigation. Do not rely on it in an emergency.

Wildheart is not a search-and-rescue service, does not monitor your hike, and will not send help.

AI features

Trip briefs and the on-trail companion generate their answers with AI. Those answers are informational only. They can be wrong, incomplete, or a bad fit for your situation, and they are not professional, medical, safety, or emergency advice. Do not rely on an AI answer when your safety depends on it. In an emergency, call emergency services.

Trail descriptions themselves are drawn from cited sources rather than generated, and we intend to keep it that way.

Your license to use the app

The Wildheart app is licensed to you, not sold. Your license to the app itself is Apple's standard Licensed Application End User License Agreement, which you can read at apple.com/legal/internet-services/itunes/dev/stdeula. These Terms govern the service behind the app, including your account, your content, and any subscription. Where the two genuinely conflict about the app binary itself, Apple's agreement wins.

Wildheart, the Wildheart name, the marks and design of the app and this site, and our compiled trail database belong to Concept Adventure LLC or its licensors. These Terms give you a personal, non-transferable right to use the app and nothing more. Trail data carries the license of its source; OpenStreetMap data is used under the Open Database License and is attributed accordingly.

Your account

You can use much of Wildheart without an account. If you create one through Sign in with Apple or Google, you are responsible for what happens under it and for keeping access to the sign-in method you used. You must be at least 13 years old. Everything about what an account stores is in the Privacy Policy.

You can delete your account at any time from inside the app. The path and the timing are in the Privacy Policy and on the Support page.

Wildheart Adventurer

Wildheart Adventurer is an auto-renewing subscription, offered annually and monthly. It unlocks Trail Studio without the limits the free tier carries, and includes an allowance of credits for the app's AI features.

  • Payment is charged to your Apple Account when you confirm the purchase.
  • The subscription renews automatically at the same price unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Apple charges for a renewal within 24 hours before the current period ends.
  • You can manage the subscription and turn off auto-renew in your Apple Account settings after purchase. Deleting the app does not cancel it.
  • There is no free trial. The free tier is the trial, and you can stay on it as long as you like.

Founding price. The annual price shown today is a founding price. We may change prices in the future, and any change applies to new subscriptions only: if you are already subscribed, your price does not move while your subscription stays active. If you cancel and come back later, you join at whatever the price is then. That grandfathering is our commitment and we hold ourselves to it; the billing mechanism behind it is Apple's. If an increase ever did reach an existing subscription, Apple notifies you before it takes effect, and depending on the size and the frequency of the increase Apple may also require your explicit agreement, without which the subscription simply does not renew.

Refunds. Apple is the merchant of record for every purchase, so Apple handles billing and refunds. We cannot issue a refund. Request one at reportaproblem.apple.com. If something we did caused the problem, tell us anyway and we will help you make the case.

Cancelling stops future billing. It does not delete anything: your routes, trips, and drawn trails stay in your account, and Trail Studio returns to free-tier limits.

Credits

Credits meter the app's AI features. A subscription includes a credit allowance for its period.

  • Credits are not money, not a stored-value instrument, and have no cash value.
  • Credits are not sold separately today, and they cannot be sold, transferred, or exchanged between people.
  • Unused credits do not roll over into the next period.
  • Credits expire when the subscription that granted them ends.
  • We may adjust what a given AI feature costs in credits as the underlying models change. We will not make a change like that retroactive.

The free tier

A substantial part of Wildheart is free and is meant to stay that way: browsing and searching trails, the canonical route for any trail and its real start points, tracking a hike, and your recap afterwards. Some creation features are metered on the free tier; the current limits are shown in the app.

We may change what the free tier includes. We will not quietly take away something you already paid for.

Your content

Routes you save, routes you draw, tracked hikes, notes, and photos are yours. You keep ownership of them.

You give us the license we need to run the Service: to store your content, process it, and display it back to you across your devices. If you deliberately share a route, that license extends to rendering it on the page the share link points to, for as long as the link is live. We do not use your content to train models and we do not publish it anywhere you did not ask us to.

You are responsible for what you upload. Do not upload anything you do not have the right to, and do not upload anything unlawful.

Acceptable use

Do not do these things with Wildheart:

  • Scrape, bulk-download, or systematically extract our trail data, routes, or any other part of the Service.
  • Resell, redistribute, or build a competing product out of data obtained from the Service.
  • Reverse engineer, decompile, or tamper with the app, or work around a limit, meter, or paywall.
  • Use automated means to place load on our servers, or interfere with anyone else's use of the Service.
  • Use the Service to break the law, to trespass, or to encourage anyone else to do either.
  • Upload anything abusive, unlawful, or infringing.

Suspension and termination

We can suspend or close an account that breaks these Terms, or that puts the Service or other people at risk. Where we reasonably can, we will tell you why first. You can stop using Wildheart at any time and delete your account from inside the app. If we close a paid account for a reason that is not your fault, tell us and we will help you get an appropriate refund from Apple.

Changes

Wildheart changes constantly, and features may be added, altered, or removed. If we make a material change to these Terms, we will update the effective date above and give notice in the app. Continuing to use the Service after that means you accept the revised Terms.

Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty about the accuracy or completeness of trail data. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this may not apply to you.

Limitation of liability

To the maximum extent permitted by law, Concept Adventure LLC and its members, officers, and contractors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, for any loss of data, profits, or goodwill, or for personal injury, death, or property damage arising from your outdoor activities, in each case arising out of or relating to your use of or inability to use the Service.

To the maximum extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or fifty United States dollars.

Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence where the law forbids excluding it. Some jurisdictions do not allow these limitations, so parts of this may not apply to you.

Indemnity

You agree to indemnify and hold harmless Concept Adventure LLC from claims, damages, and reasonable legal costs arising out of your misuse of the Service, your violation of these Terms, or your infringement of someone else's rights.

Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.

Before filing any claim, email [email protected] and give us 30 days to work it out. Nearly everything is fixable by one person reading one message. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Travis County, Texas, and you and we each consent to that jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory laws in your country of residence.

Apple

Apple is not a party to these Terms and is not responsible for Wildheart or its content. Apple has no obligation to provide maintenance or support for the app. Your subscription is subject to Apple's terms as well as ours, and any claim about the app failing to conform to a warranty may be directed to Apple for a refund of the purchase price. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

General

If any part of these Terms is unenforceable, the rest stays in force. Our not enforcing something is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
